1. INTRODUCTION

Welcome to Gameday Technologies Inc. ("Provider," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our software and services ("Services"). By using our Services, you agree to comply with these Terms.

2. ACCEPTANCE OF TERMS

By accessing or using the Services, you confirm you’ve read and accepted these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

3. ELIGIBILITY

  • You must be at least 18 years old to register for a coach or administrator account.

  • Youth users (ages 8–18) may access the Services with a linked team account and coach or guardian oversight.

  • Children under 13 must have verifiable parental consent in accordance with COPPA.

4. ACCOUNT REGISTRATION

4.1 All information provided must be accurate and complete.
4.2 You are responsible for maintaining confidentiality of your credentials.
4.3 You agree to immediately notify us of unauthorized use of your account.

5. USE OF SERVICES

5.1 You may use the Services only for lawful purposes.
5.2 You agree not to:

  • Reverse engineer, disrupt, or attempt unauthorized access.

  • Upload or share inappropriate, harmful, or misleading content.

  • Allow minors to access features without appropriate consent.

  • Use the platform for commercial exploitation without our approval.

6. YOUTH INTERACTIONS

  • Features accessible to youth users are limited to team-based content and performance tracking.

  • Social features are restricted to team environments and monitored for compliance.

  • Coaches and guardians are responsible for managing player participation and permissions.

7. FEES & PAYMENT

7.1 Some features may require a subscription or payment.
7.2 Fees are non-refundable unless otherwise stated or required by law.
7.3 We may adjust pricing with reasonable notice.

8. INTELLECTUAL PROPERTY

All content, branding, and code associated with the Services is owned by Gameday Technologies Inc. You may not reproduce or redistribute without written consent.

9. DATA PRIVACY

9.1 We collect and use data in accordance with our Privacy Policy.
9.2 By using the Services, you consent to our data handling practices, including the collection of youth data with appropriate consent.

10. TERMINATION

We may suspend or terminate access if Terms are violated. Upon termination, rights to access the Services cease.

11. DISCLAIMER & LIMITATION OF LIABILITY

  • Services are provided “as is.” We do not guarantee uninterrupted access.

  • We are not liable for indirect or consequential damages.

  • Our liability is capped to fees paid by you in the prior 12 months.

12. GOVERNING LAW

These Terms are governed by the laws of Ontario and applicable Canadian federal laws.

13. CHANGES TO TERMS

We may update these Terms. Continued use of the Services implies agreement to the latest version.
